All cancellations must be received with 30 days of notice to end of service in writing. In writing includes: regular mail, e-mail, and fax notifications. Telephone requests will not constitute acceptance of cancellation. For example, if you wish to end services on July 30th, then you must turn in notice by June 30th. Termination requests MUST include:

- Exact service/s terminating
- Termination effective date
- Reason for terminating

ClickCom, Inc. is not responsible for data (i.e. emails, website files, etc.) that is lost due to termination of services by the Client or by termination of services initiated by ClickCom due to non-payment. Client may request a copy of any website files at a minimum charge of $25.00. This request must proceed or accompany Client's termination notice. This service is not available for Clients with past due amounts.

Billing
Payment is due prior to usage for all services. ClickCom will select the user “Day of Month Billing” (DOMB), the day each month that all rates are due. Additional services added after original services will be prorated to the client’s DOMB.

Website Hosting/Virtual Pointers/Website Space
Billing begins the next business day after above website space is setup by ClickCom. Billing is not determined by weather Client has uploaded files to website nor if functioning properly due to Client error.

Business Website Hosting/Virtual Pointers/Dedicated Access
Refunds will be issued only for full months usage paid in advanced for usage after the date of termination. No partial month refunds will be issued.

Shared Secure Server
No Pro-rated refunds regarding this service.
|
|
Domain Name Modifications
ClickCom, Inc. will assist Client in modification of domain Technical Contact to ClickCom, but not away from ClickCom to competitor. Assistance with modifications to domain name other than Technical Contact will be charged a fee of $75 per hour with a minimum $25.00 assistance fee.

Client Data
ClickCom provides no warranties, express or implied, for any of its products or services. ClickCom further agrees to make a good faith effort to restrict unauthorized access to the client's data. However, due to the insecure nature of the Internet, the client assumes full responsibility for providing appropriate security within the client's own directories. ClickCom is not responsible for loss of data. Even though ClickCom conducts daily tape back-ups, due to the insecure nature of the Internet we cannot guarantee the security of the client's data. Client should therefore back-up their own data. Client understands that ClickCom will not provide refunds of Secure Server accounts.

Scripts
We do not allow the use of insecure scripts on our servers. This includes commonly abused Formmail scripts. There are many alternatives to Formmail scripts and we recommend investigating the code for security threats before uploading to your website. If you have any questions contact support for guidance before uploading. If you upload a file that causes the server to be abused by spammers, the insecure script may have to be deleted depending on the severity of the threat that you have opened. We want all of our servers to be safe and used only for legitimate purposes. Please be mindful of this before uploading scripts to your website.

Termination of Service
Below are many points of our Terms of Service which are likely to result in ClickCom, Inc. terminating the service or services provided.

- Use of our service for an illegal activity. Using the Services to transmit any material that, intentionally or unintentionally, violates any applicable local, state, national or international law.
- Using the Services to transmit any material that threatens or encourages bodily harm or destruction of property.
- Using our services to transmit any material that harasses another. This includes using the service to contact ('stalk') someone who does not wish to be contacted by you.
- Using our services to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam.
- Attempting to impersonate any person by using forged headers or other identifying information is prohibited. This includes any kind of network traffic altering ('Spoofing').
- Unsolicited commercial email/unsolicited bulk email using the services to transmit any unsolicited commercial email or unsolicited bulk email. Termination of services without refund is to be expected on first offense. Opt-in lists where the user has given their email address willingly does not qualify as spam.
- Any and all attempts to negotiate around security devices ('Hacking/Cracking'), physical or otherwise, successful or not, will not be tolerated.
- Any attempt to perform or cause ClickCom to be the recipient of a Denial of Service attack ('DoS/DDos') is grounds for termination and will result in the involvement of local law enforcement.
- Any service that is used to transmit or assist in the transmission of copyrighted materials without the owner's consent.
- Subletting of services is prohibited except under the express conditions surrounding our reseller opportunities.
- Using a personal account for high volume or commercial use is prohibited. The Services are intended for periodic, active use of email, newsgroups, file transfers, Internet chat, games, and browsing the World Wide Web. Members may stay connected so long as they are actively using that connection for the above purposes. Members may not use the services on a standby or inactive basis in order to maintain a connection. Pinging in order to maintain your connection is expressly prohibited.
